Notice of Intended Action
ARC 4691C has been published as a Notice of intended action to amend Chapter 17, “Wholesaler Distributor Licenses,” Chapter 42, “Limited Distributor Licenses,” and Chapter 43, “Third-Party Logistics Provider Licenses.”

The proposed amendments provide: 1) the process by which a limited distributor, wholesale distributor, or third-party logistics provider (3PL) would notify the board of a change in facility manager, 2) the process by which a wholesale distributor or 3PL would modify the license to reflect a change in facility manager, and 3) corrections to references to the Iowa Code.

The proposed rulemaking temporarily places six synthetic cathinones into schedule I of the Iowa CSA in response to action taken by the DEA.

ARC 4693C has been published as a Notice of intended action to amend Chapter 6, “General Pharmacy Practice, Chapter 7, “Hospital Pharmacy Practice,” Chapter 8, “Universal Practice Standards,” and Chapter 18, “Centralized Prescription Filling and Processing.”

The amendments would allow a pharmacist to fill a non-patient specific prescription for the purpose of expedited partner therapy to treat sexually transmitted infections in an unnamed partner or partners.

ARC 4694C has been published as a Notice of intended action to amend Chapter 6, “General Pharmacy Practice.”

The amendment would allow one pharmacy to provide prescription drug order information to another pharmacy for a non-controlled substance prescription for the purpose of providing a patient with a three day supply of continuing medication and the process not constituting a complete transfer of the entire prescription.

The proposed amendments would:

Replace the phrase “tech-check-tech programs” with “technician product verification programs” throughout administrative rules,

Require a nonresident pharmacy applicant to identify a registered agent located in Iowa,

Extend the time frame in which a pharmacy must respond to a records request from 48 to 72 hours,

Amend language relating to requirements for closing a pharmacy which may be exempt in the event of an unforeseeable closure, and
-
Simplify the rule relating to the delivery of prescription drugs.

Adopted
ARC 4701C has been Adopted and amends Chapter 10, “Controlled Substances,” and Chapter 100, “Iowa Real-Time Electronic Pseudoephedrine Tracking System.”
The rulemaking adds pharmacy support persons and technician trainees to the list of authorized dispensers. Pharmacies are reminded that each authorized dispenser is required to have an individual login to identify who authorized the transaction.
The rules will be effective November 13, 2019.
