Notice of Intended Action
ARC 4570C has been published as a Notice of Intended Action to amend Chapter 10, “Controlled Substances,” and Chapter 100, “Iowa Real-Time Electronic Pseudoephedrine Tracking System,” Iowa Administrative Code.
- The proposed amendments, developed with the approval of the Governor’s Office of Drug Control Policy, expand the authorized dispensers to include all pharmacy employees, including pharmacy support persons and technician trainees.
- Comments may be submitted no later than 4:30pm on August 20, 2019.

ARC 4579C is rulemaking which has been Adopted by the Board and amends Chapter 2, “Pharmacist Licenses,” Chapter 4, “Pharmacist-Interns,” Chapter 25, “Child Support Noncompliance,” Chapter 31, “Student Loan Default or Noncompliance with Agreement for Payment Obligation,” and Chapter 32, “Nonpayment of State Debt,” Iowa Administrative Code.

The rulemaking, in part:

Updates the language for licensure application, examination eligibility, and license transfer to be consistent with current procedure through NABP;

Expands the options for a foreign pharmacy graduate to fulfill internship requirements at Iowa-licensed pharmacies to include pharmacies other than community or hospital sites;

Removes the option of a foreign pharmacy graduate to petition the Board for credit toward internship resulting from the graduate’s pharmacy experience in a foreign country;

Adds a criminal background check requirement for new pharmacist license applicants; and
-
Requires pharmacists to notify the board within 30 days of any criminal conviction, plea, or disciplinary action.

The rules will be effective September 4, 2019.
ARC 4581C is rulemaking which has been Adopted and amends Chapter 36, “Discipline,” and rescinds Chapter 31, “Student Loan Default or Noncompliance with Agreement for Payment of Obligation,” Iowa Administrative Code.

The amendments implement Senate File 304, enacted during the 2019 Legislative Session, which prohibits a licensing agency from taking formal disciplinary action against a licensee for default of a student loan.

The amendments will be effective September 4, 2019
ARC 4582C is rulemaking which has been Adopted and amends Chapter 33, “Military Service and Veteran Reciprocity,” Iowa Administrative Code.

The rulemaking implements House File 288, enacted during the 2019 Legislative Session, which requires professional licensing agencies to implement expedited license processing for spouses of active duty military personnel.

ARC 4583C is rulemaking which has been Adopted and amends Chapter 39, “Expanded Practice Standards,” Iowa Administrative Code.

The amendments provide language which identifies an order issued by a pharmacist under a statewide protocol as constituting a prescription for the purpose of submission of third-party insurance claims.
