The Iowa Board of Pharmacy (“Board”) took the following actions at its most recent meeting held on January 9, 2019:

Hy-Vee Pharmacy 1044 (Burlington), Pharmacy.  Hy-Vee Pharmacy 1044 entered into a Combined Statement of Charges, Settlement Agreement, and Final Order with the Board.  The Order charged the pharmacy with employing a pharmacy technician without a current registration and resolved the charge by issuing a citation and warning and imposing a civil penalty in the amount of $1,000.

Allison Heffelfinger, Pharmacist.  Pharmacist Heffelfinger entered into a Combined Statement of Charges, Settlement Agreement, and Final Order with the Board.  The Order charged the pharmacist with employing a pharmacy technician without a current registration and resolved the charge by issuing a citation and warning and imposing a civil penalty in the amount of $250.

Stephanie Graham, Certified Pharmacy Technician.  Technician Graham entered into a Combined Statement of Charges, Settlement Agreement, and Final Order with the Board.  The Order charged the technician with working without a current registration and resolved the charge by issuing a citation and warning and imposing a civil penalty in the amount of $100.

Rajan Devan, Pharmacist.  Pharmacist Devan entered into a Reinstatement by Consent Agreement with the Board, which reinstates his pharmacist license upon re-taking and passing the MPJE.  Pursuant to the Agreement, Pharmacist Devan is permanently restricted from serving as a pharmacist in charge and from having an ownership interest in any pharmacy licensed in Iowa.

Heather Jeffords, CSA Registrant.  The Board issued a Reinstatement Order fully reinstating the CSA registration of Physician Assistant Jeffords. 

Hy-Vee Pharmacy 1192 (Fort Dodge), Pharmacy.  The Board issued a Notice of Hearing and Statement of Charges against the Hy-Vee Pharmacy 1192, charging the pharmacy with failing to fulfill its responsibilities as a managing pharmacy for the telepharmacy site located in Manson.  A hearing is scheduled for March 12, 2019.

Hy-Vee Pharmacy 3191 (Manson), Limited Use Pharmacy.  The Board issued a Notice of Hearing and Statement of Charges against Hy-Vee Pharmacy 3191, charging the limited use pharmacy with failing to comply with the requirements governing telepharmacy sites.  A hearing is scheduled for March 12, 2019.

Thomas Donner, Pharmacist.  The Board issued a Notice of Hearing and Statement of Charges against Pharmacist Donner, charging the pharmacist with failing to ensure legal operation as the pharmacist in charge of Hy-Vee Pharmacy 1192 and Hy-Vee Pharmacy 3191.  A hearing is scheduled for March 12, 2019.

CVS Pharmacy 8546 (Waterloo), Pharmacy.  The Board issued a Notice of Hearing and Statement of Charges against CVS Pharmacy 8546, charging the pharmacy with having a non-compliant CQI program and failing to timely provide records.  A hearing is scheduled for March 12, 2019.

David Schlichtemeier, Pharmacist.  The Board issued a Notice of Hearing and Statement of Charges against Pharmacist Schlichtemeier, charging the pharmacist with unprofessional behavior.  A hearing is scheduled for March 12, 2019.

The Board voted to approve the following actions in regards to its administrative rules:

  • Adoption and filing of amendments to chapters 5, 7, and 8 with minor changes to the language published in the notice (ARC 4029C) in response to comments received.
  • Adoption and filing of amendments to chapter 10 with identical language to the published notice (ARC 4086C). 
  • Adoption and filing of amendments to chapter 4 with minor changes to the language published in the notice (ARC 4091C) in response to comments received.
  • Adoption and filing of amendments to chapters 8 and 13 with identical language to the published notice (ARC 4092C). 
  • Adoption and filing of amendments to chapter 39 with minor changes to the language published in the notice (ARC 4096C) in response to comments received.
  • Filing a notice of intended action to amend chapter 10, “Controlled Substances.” 
  • Filing a notice of intended action to rescind and replace chapter 40, “Technology-Assisted Technician Product Verification Programs.”
